Terms of Service for JusTrade

Welcome to myjustrade.com (the “JusTrade Site”), owned and operated by CarPair LLC, its parent and/or subsidiaries (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of and participation in our services, including the JusTrade Site, our online and/or mobile services, and related software (collectively, the “JusTrade Service”).

Description of Services

JusTrade connects car sellers and buyers. The JusTrade Service acts as a meeting place only; the actual contract for sale of each car listed on the Service is directly between the seller and the winning buyer.

User Agreement

By accessing or using the JusTrade Service or registering for an account on the JusTrade Site, you agree to be bound by these Terms and the JusTrade Privacy Policy, which is incorporated by reference. If you do not agree, you are prohibited from using the JusTrade Site or Service.

Lawful Use and Compliance

You must comply with all rules, restrictions, limitations, terms, and conditions of the Agreement. Breach of these terms may result in the termination, discontinuation, suspension, or restriction of your account/profile and access to the JusTrade Service. We reserve the right to take technical, legal, and other actions to prevent violations and enforce the Agreement.

Data Collection and Use

We may require registration and/or account/profile creation to access certain parts of the JusTrade Service. You must provide true, accurate, complete, and up-to-date registration information. We use and share this information as described in our Privacy Policy. You are responsible for maintaining the confidentiality of your registration information and ensuring that no one else accesses your account/profile without your authorization.

Listings and Fees

• Seller Responsibilities: Sellers must make reasonable efforts to complete the sale of their listed vehicles if there is a winning buyer. Sellers may not remove a car from a listing before the end of the listing period and may not list the same car on any other auction, dealership, listing service, or publication while it is listed on JusTrade.
• Buyer Responsibilities: Buyers acknowledge that their bids are binding and they are responsible for all applicable government fees and taxes for the vehicle won through such bid.
• Fees: We may charge fees for certain services or listings. These fees will be clearly communicated to you before you incur any charges.

Monitoring and Complaints

We may monitor activity on the JusTrade Site to ensure compliance with the Agreement. If you have a legitimate complaint about the JusTrade Site or Content, please contact us at info@myjustrade.com

Intellectual Property

Content provided by us, our licensors, vendors, and/or service providers is protected by local, state, federal, provincial, national, international, and foreign copyright, trademark, and other intellectual property laws. You must use such Content only to the extent expressly authorized.

Rules of Usage

• Age Restriction: The JusTrade Service is not intended for users under 16 years old.
• Equipment and Software: You must ensure that your equipment, hardware, software, products, and/or services do not disturb or interfere with our operation of the JusTrade Service.
• Export Control: You must comply with all applicable import and export control laws, rules, and regulations.
• Prohibited Parties: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties.

Termination and Amendments

We reserve the right to modify these Terms at any time. Continued access to the JusTrade Service constitutes your acceptance of any changes. We may terminate, discontinue, suspend, or restrict your account/profile and access to the JusTrade Service with or without notice.

Governing Law

These Terms and the Agreement shall be governed by and construed in accordance with the laws of the state and country in which we are located, without giving effect to any principles of conflicts of law. Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

By using the JusTrade Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and the JusTrade Privacy Policy.
